1. Corporate Structure, Ownership, and Legal Entity Status
Anastasia's Production Crew LLC (the "Company," "we," "us," or "our") is a duly formed Limited Liability Company organized under the laws of the State of Nevada, United States of America. The Company is expressly designated as a subsidiary entity under the ownership, governance, and controlling interest of Kepansi Productions (the "Parent Organization"). All operational authority, intellectual property rights, and executive decision-making powers are vested in Anastasia's Production Crew LLC, subject to oversight by Kepansi Productions. Any reference to the "Company" includes its parent organization, subsidiaries, affiliates, members, managers, officers, employees, contractors, and authorized agents.
2. Acceptance of Terms and Binding Agreement
These Terms of Service constitute a legally binding agreement between Anastasia's Production Crew LLC and any individual or entity accessing or using the Services ("User," "you," or "your"). By accessing, interacting with, or utilizing any portion of the Services, you acknowledge that you have read, understood, and voluntarily agree to be bound by these Terms. If you do not agree, you are strictly prohibited from accessing or using the Services.
3. Definitions and Scope of Services
"Services" includes, without limitation, all digital platforms, websites, production environments, recording sessions, audiovisual outputs, community servers, interactive events, and any affiliated or derivative media operated or controlled by the Company. The Company reserves the absolute right to expand, modify, suspend, or discontinue any portion of the Services at its sole discretion without prior notice or liability.
4. User Eligibility and Representations
You represent and warrant that you are at least thirteen (13) years of age. If you are under eighteen (18), you affirm that you have obtained valid consent from a parent or legal guardian. You further represent that all information provided to the Company is accurate, complete, and not misleading in any material respect.
5. Account Responsibility and Community Participation
Certain Services may require participation in third-party platforms including Discord or Roblox. You agree to maintain the confidentiality of any credentials associated with your participation and assume full responsibility for all activities conducted under your access. The Company reserves the right to restrict, suspend, or permanently terminate access for violations of community standards, moderator directives, or operational integrity requirements.
6. Intellectual Property Rights
All content, materials, and intellectual property created, developed, or distributed by the Company shall remain the exclusive property of Anastasia's Production Crew LLC and its parent organization, Kepansi Productions. This includes, without limitation, recordings, scripts, storylines, branding, logos, audiovisual works, software interfaces, production formats, and derivative works. Users are strictly prohibited from copying, reproducing, redistributing, modifying, or commercially exploiting any Company intellectual property without prior express written authorization.
7. Media Release and Content License
By participating in any recording session, production, or interactive Service, you hereby grant the Company and its parent organization a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable license to record, capture, use, reproduce, edit, distribute, publicly display, and create derivative works from your participation in any form of media. This includes your voice, likeness, avatar, gameplay, written input, and performance contributions. You expressly waive any right to compensation, attribution, approval, or inspection of any finished or derivative production.
8. DMCA Copyright Policy and Procedures
The Company complies fully with the Digital Millennium Copyright Act (17 U.S.C. § 512). All copyright infringement notices must be submitted to dmca@apcrecordingcrew.com. Valid notices must include identification of copyrighted material, identification of allegedly infringing content, contact information, a statement of good faith belief, a statement under penalty of perjury, and a valid signature. False or fraudulent DMCA claims may result in legal liability under applicable federal law.
9. Prohibited Conduct and Enforcement Authority
Users shall not engage in harassment, abuse, threats, hate speech, discrimination, exploitation, unauthorized access, system disruption, malicious activity, or interference with other Users or Services. The Company retains sole discretion to investigate, moderate, suspend, or permanently ban any User for violations of this Agreement and may refer unlawful conduct to appropriate law enforcement authorities.
10. Disclaimer of Warranties
The Services are provided strictly on an "AS IS," "AS AVAILABLE," and "WITH ALL FAULTS" basis. The Company disclaims all warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. No guarantee is made regarding uninterrupted, error-free, or secure operation of the Services.
11. Limitation of Liability
To the maximum extent permitted by law, Anastasia's Production Crew LLC and Kepansi Productions shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising out of or relating to the Services, including loss of data, loss of access, community disputes, moderation actions, or third-party platform failures. Total liability, if any, shall not exceed the amount paid by the User for access to the Services.
12. Indemnification
You agree to indemnify, defend, and hold harmless Anastasia's Production Crew LLC, Kepansi Productions, and their respective affiliates, members, and agents from any claims, damages, liabilities, costs, or expenses arising out of your violation of these Terms or misuse of the Services.
13. Third-Party Platforms and Integrations
The Services may operate in conjunction with third-party platforms including Discord, Roblox, YouTube, and others. The Company assumes no responsibility for the availability, policies, enforcement actions, or failures of such platforms. Users remain subject to the independent terms and conditions of those platforms.
14. Termination of Access
The Company reserves the right to suspend, restrict, or permanently terminate access to the Services at any time, with or without notice, cause, or liability. Upon termination, all rights granted under this Agreement shall immediately cease.
15. Governing Law and Venue
This Agreement shall be governed exclusively by the laws of the State of Nevada, United States of America. Any disputes arising under this Agreement shall be resolved exclusively in the state or federal courts located within Nevada, and you hereby consent to such jurisdiction and venue.
16. Modifications to Terms
The Company reserves the right to modify or update these Terms at any time at its sole discretion. Continued use of the Services following any modifications constitutes acceptance of the revised Terms.
17. Severability and Entire Agreement
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. This Agreement constitutes the entire agreement between the User and the Company and supersedes all prior understandings.
